Disability Rights Complaints in Chennai: State Commissioner Guide

Denied a disability right by a state office? The State Commissioner in Chennai takes free complaints. Here is how to file, and why the post itself is in the news.

Disability rights: where to complain in Chennai

If a Tamil Nadu government office, school, hospital or local body denies a disabled person a right under the Rights of Persons with Disabilities Act, 2016, the complaint goes to the State Commissioner for Persons with Disabilities in Chennai. Filing costs nothing and needs no lawyer or set format. Complaints against Union government bodies go to the Chief Commissioner in Delhi instead.

The office has a problem, though. The national list of state commissioners still showed Tamil Nadu’s post as vacant when we checked. In July 2026 the Supreme Court ordered every state without a full-time commissioner to appoint one within four weeks. This guide explains what the commissioner can do, how to file, and where the appointment stands.

What the State Commissioner is for

Sections 79 to 83 of the 2016 Act create the post in every state. The summary of these sections published by one state commissioner’s office lists the main duties:

  • Inquire into complaints that a disabled person has been denied rights or safeguards, where the state government is responsible, and push the authority concerned to put it right.
  • Point out state laws, policies and procedures that clash with the Act and recommend changes.
  • Monitor how the Act and disability schemes are carried out, including how state money for disabled people is spent.
  • Promote awareness of disability rights and research on them.

Two sections give the office teeth. Under Section 81, an authority that receives the commissioner’s recommendation must report within three months what it has done. If it rejects the recommendation, it must give reasons within the same period and tell the person who complained. Under Section 82, the commissioner has some civil court powers: to summon witnesses, call for documents and public records, and take evidence on affidavit.

Where the office is and how to reach it

The Chief Commissioner’s directory gives Tamil Nadu’s office as:

  • State Commissioner for Persons with Disabilities, No. 5, Kamarajar Salai, Lady Wellington College Campus, Chennai 600005
  • Phone: 044-28444940
  • Email: scd.tn@nic.in or scpwdtn@gmail.com

This is the same campus as the state’s Commissionerate for Welfare of the Differently Abled, which also lists 044-28444941. The department’s history explains why. It was carved out of the social welfare commissionerate in 1992 and upgraded to the office of the State Commissioner for the Disabled in 1999, under the older 1995 disability law. Since then, the head of the welfare department has also acted as commissioner.

Vacant post and the Supreme Court order

That double role is what the Supreme Court has now ruled against. On 29 July 2026, in Rajive Raturi v Union of India, a bench of Justices JB Pardiwala and KV Viswanathan ordered states that had not appointed commissioners under Section 79 to do so within four weeks, LiveLaw reported. The appointee must hold independent charge.

The petitioners’ counsel named Tamil Nadu among ten states and union territories without a commissioner. According to a summary of the order, the court said states should not appoint anyone holding additional charge. The case is listed again on 20 January 2027 to check compliance.

We could not find a published notification of a new Tamil Nadu appointment by 18 October 2026. Complaints can still be sent to the office address above, which continues to receive them.

How to file a complaint

The Chief Commissioner’s FAQ describes the process for its own office, and state offices follow the same basic pattern:

  1. Write to the commissioner by registered post or email. A person with a disability can file directly or through someone they authorise.
  2. Give your name, address, phone and email, and the name and address of the office you are complaining about.
  3. Set out what happened, when and where, and what you want done, such as a ramp installed, a seat restored or an exam scribe allowed.
  4. Attach a self-attested copy of your disability certificate or UDID card, and any letters or photos that support the complaint.
  5. Add a line saying the matter is not pending before any court.

There is no fee. The Chief Commissioner’s office has held hearings online since June 2020 and aims to decide complaints within three months of notice reaching the other side, so you need not travel. Keep copies and the postal receipt.
